1. Operator

The HeyZenek service (the “Service”) is operated by:

Throughout this document, “we”, “us” or “our” refers to the operator above. “You” refers to the user of the Service.

2. The Service

HeyZenek provides AI-powered tools for working with text — writing, editing, summarizing, translating, generating flashcards, quizzes and more. The Service includes a web application, a browser extension and a desktop application.

3. Account and Eligibility

  • You must be at least 16 years old to use the Service.
  • You must provide accurate registration details and keep them up to date.
  • You are responsible for keeping your password secure. We are not liable for losses caused by unauthorized access if you failed to protect your credentials.

4. Acceptable Use

You agree not to:

  • Use the Service for unlawful purposes, including generating content that infringes third-party rights, defames others or violates applicable law.
  • Submit personal data of third parties without their consent.
  • Attempt to interfere with the Service's infrastructure, reverse-engineer its code or circumvent access controls.
  • Use the Service to generate spam, malware or content intended to deceive automated systems.
  • Resell or redistribute access to the Service without our written consent.

We may suspend or terminate accounts that violate these terms.

5. Plans and Payments

  • The Service is offered on a monthly subscription model. Specific plans and prices are listed on our pricing page.
  • Payments are processed exclusively through Stripe, which acts as the merchant of record for your purchase (“Sold through Link”). Stripe collects the payment, calculates and remits any applicable VAT, GST or sales tax, issues receipts and invoices, and handles refund requests and payment disputes. By making a payment, you also agree to Link's terms shown at checkout.
  • Prices are listed in USD and exclude tax unless the checkout shows otherwise; the exact amount, currency and tax for your location are shown at checkout before you pay.
  • Subscriptions renew automatically each billing period unless canceled before renewal.
  • You can change plans at any time from the account settings, in either direction. A plan change takes effect immediately: a new billing period starts that day, you pay the full price of the new plan, and the unused allowance of the current plan carries over to the new one until the end of that billing period. The remaining part of the period you already paid for is not refunded.
  • You can cancel your subscription at any time from the account settings. Cancellation takes effect at the end of the current billing period. Until then you keep access, and choosing any plan from the pricing page starts it that day under the rule above.

6. Right of Withdrawal (Digital Content)

Because the Service consists of digital content delivered immediately upon purchase, by completing a purchase you explicitly consent to the immediate execution of the contract and acknowledge that you lose the statutory 14-day right of withdrawal under EU consumer law (Directive 2011/83/EU, Art. 16(m)).

7. AI-Generated Content

  • The Service uses third-party large language models (currently OpenAI) to generate text. Generated content is provided “as is” and may contain errors, inaccuracies or biases.
  • You are responsible for reviewing and verifying any output before relying on it, especially in contexts where accuracy matters (legal, medical, financial, academic).
  • We do not guarantee that generated content is free of similarity to existing works. You are responsible for ensuring your use complies with applicable copyright law.

8. Your Content

  • You retain ownership of the text you submit and of the output generated for you.
  • You grant us a limited, non-exclusive license to process your text solely for the purpose of providing the Service (sending it to AI processors and displaying results back to you).
  • We do not claim ownership over your inputs or outputs.

9. Recipients

To provide the Service, we share necessary data with the following recipients:

  • OpenAI — for AI text generation
  • Stripe — for payment processing
  • Google (Google Forms API) — only when you choose to export a quiz to Google Forms
  • Infrastructure providers — Hetzner Online GmbH, Cloudflare, Inc., Resend, Inc.

10. Availability and Changes

  • We aim for high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates or events beyond our control.
  • We may modify, add or remove features at any time. Material changes affecting paid plans will be announced in advance via email or in-app notice.

11. Liability

To the maximum extent permitted by law, our liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental or consequential damages.

This clause does not limit liability that cannot be excluded under applicable mandatory law (e.g., consumer rights, gross negligence).

12. Termination

  • You may delete your account at any time from Settings → Account → Delete account. For your security, deletion requires confirming your current password.
  • Account deletion is immediate and irreversible.
  • If you have an active subscription, it is canceled automatically as part of the deletion. Charges already incurred are non-refundable, subject to the Right of Withdrawal above and to Stripe's refund policy for purchases sold through Link.
  • We may suspend or terminate your access if you violate these terms or applicable law. Where reasonable, we will notify you first and give you a chance to cure the issue.

13. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Material changes will be announced via email or in-app notice. Continued use of the Service after an update constitutes acceptance of the updated Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of Poland. Any disputes shall be resolved by the Polish courts having jurisdiction, unless mandatory consumer protection law grants you the right to bring proceedings before another court.
